Terms of use
These terms are the agreement between you and Cummins Family Pty Ltd (ABN 66 164 374 172), which runs The Piggy. We've written them to be read.
What The Piggy is
The Piggy is an app for keeping count of chores and pocket money. It doesn't hold, send or pay money, and it isn't a bank. You pay your kids yourself, in cash or however you like, and mark it paid in the app.
In these terms "we" and "us" means Cummins Family Pty Ltd, and "you" means the parent or carer using The Piggy. By setting up or joining a family, or choosing a plan, you agree to these terms.
Who can use it
- Parents and carers aged 18 or over. One adult sets up a family and can invite others, up to 4 parents or carers in all.
- Kids don't have accounts. A parent adds each child by first name, and sets up the child's own device or lets the family share one.
- You look after the devices you set up for your kids, and the email account you sign in with, since that's where our codes go.
- Please put in only what The Piggy needs: first names, chores and amounts. Don't put surnames, addresses or other personal details in names, notes or goals.
The family plan and prices
- One plan covers the whole family: every child, up to 4 parents or carers, and all your devices.
- It costs A$5.99 a month or A$49 a year, in Australian dollars. Cummins Family Pty Ltd isn't registered for GST, so no GST is charged: the price you see is the price you pay.
- Stripe takes the payments, by card, Apple Pay or Google Pay. Your card statement shows THEPIGGY.COM.AU.
- Only the parent who set up the family can choose, change or cancel its plan.
The free month
- Every account gets one free month: 30 days with every feature, and no card needed.
- It starts the day your family becomes active: the day you set it up, or, if you joined from the waiting list, the day we let you in. It ends at midnight at the end of its last day, Sydney time.
- Families already using The Piggy when paid plans begin get 30 days free from that day.
- It's one per account, so a second family you set up later starts with no free days.
- Before it ends, the app asks you to choose a plan. If you choose early, you keep the rest of your free days, and nothing is charged until they run out.
- If you don't choose, nothing is charged, and your family becomes read only (see If a plan stops).
Renewing and cancelling
- Your plan renews automatically until you cancel: a monthly plan each month and a yearly plan each year, charged through Stripe.
- Cancel any time in the app: Admin, then Plan. There's no phone call, no form and no lock-in contract.
- When you cancel, your plan keeps running to the end of the time you've paid for, then stops, and nothing more is charged.
- You can switch between monthly and yearly in the same place. Monthly to yearly happens straight away, with credit for the unused part of the month. Yearly to monthly starts when the paid year ends.
- If you remove a family that has a plan, the plan is cancelled at the end of the time you've paid for.
Refunds
- You can cancel any time, and your plan runs to the end of the period you've paid for.
- We don't give refunds if you change your mind, including for part of a month or year.
- As a goodwill promise: if you pay for a yearly plan and ask us within 14 days of the payment being taken, we'll refund that payment in full and end the plan. Just email support@thepiggy.com.au.
- None of this limits your consumer guarantees under the Australian Consumer Law, below.
Your consumer guarantees
The Piggy comes with consumer guarantees under the Australian Consumer Law that can't be excluded. If there's a major failure with the service, you can cancel and get a refund for the unused part, or compensation for its reduced value. You can also claim for other loss or damage that could reasonably have been foreseen. If a failure isn't major, we'll fix it within a reasonable time, and if we don't, you can cancel and get a refund for the unused part. Nothing in these terms takes away these rights.
Keeping your price
- If you subscribe, your price stays the same for as long as you stay subscribed.
- If we change our prices, the new prices are for new subscriptions. If we ever had to change the price you pay, we'd email you at least 30 days before, and you could cancel before it applied.
The friends and family code
- We give a code to friends and family we invite. It isn't published anywhere, so please don't pass it on beyond the people we gave it to.
- Type it in the app when you choose a plan (Have a code?). If it's valid, your family's plan is free for as long as it stays subscribed, with no card needed.
- The code is for up to 25 families, and can be used for 12 months from the day paid plans begin. We can stop the code at any time, and families already on it stay free.
- It has no cash value and can't be swapped for money.
If a plan stops
- If your free month ends without a plan, or your plan ends, your family becomes read only.
- Nothing is deleted. You and your kids can still open The Piggy and see every balance, every goal and what each child is owed. You can still save a backup, manage devices and remove the family.
- New chores, ticks, approvals and payouts wait until you choose a plan again, then you pick up right where you left off.
- If a payment fails, Stripe tries again and emails you. If it still can't be paid, the plan ends and the family becomes read only.
- A family with no plan and no parent signing in for 24 months is removed. We email the parent who set it up 30 and 7 days before (see the privacy policy).
Fair use
- Use The Piggy for your own family's chores and pocket money, not to run a business.
- Don't try to break it, overload it, get around its limits or security, copy it, or get at anyone else's data.
- The Piggy has sensible limits, such as how many families one person can set up. The app tells you if you reach one.
- If someone breaks these terms, we may suspend or remove their account or family. We'll tell them why first, unless it's urgent, such as to stop harm to others.
Your family's data
Your family's records are yours. Our privacy policy says what we keep and for how long, and you can save a copy or delete it at any time.
Keeping The Piggy running
We work hard to keep The Piggy running and your records safe, but it may sometimes be unavailable, for example while we update it. The app keeps working on your devices without the internet and syncs when it's back. Save a backup file now and then if a record matters to you.
We keep improving The Piggy and may change how things work. We won't take away a main feature during a period you've paid for without offering a refund for the unused part.
Stopping, and if we ever close
- You can stop any time: cancel your plan, then remove your family or delete your account.
- If we ever decide to close The Piggy, we'll email every parent and carer with an account at least 60 days before, refund the unused part of any paid plan, and give you time to save a copy of your records.
If something goes wrong
The Piggy is a counting tool: you decide what your kids earn and what you pay them. Apart from your consumer guarantees, which nothing here limits, we're not responsible for disagreements about pocket money, or for amounts that were wrong because of what was put into the app.
Changes to these terms
If we change these terms, we'll post the new version here with its date, and email every parent and carer with an account at least 30 days before a change that affects you takes effect. If you don't agree, you can cancel before it applies.
The law that applies
These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales can hear any dispute. Please talk to us first: most things can be sorted out by email.
